Personal/carer’s leave (also known as sick leave, personal leave or sick & carer’s leave) allows an employee to take time off when they are sick or injured or to help them deal with caring responsibilities & family emergencies.

An employee may have to take time off to care for an immediate family or household member who is sick or injured or help during a family emergency. This is known as carer’s leave but it comes out of the employee’s personal/carer’s leave balance.

Full-time & part-time employees get 10 days (2 weeks) paid personal/carer’s leave, based on their ordinary hours of work.

Personal/carer’s leave accumulates from the first day of employment, even in a probation period. The leave accumulates during the year & any unused personal carer’s leave will roll over from year to year. (It is not paid out when employment ceases.)

Unpaid carer’s leave

Casual employees & any full-time or part-time employees who have used up all of their entitlement to paid carer’s leave, are entitled to up to 2 days’ unpaid carer’s leave for each occasion when a member of the employee’s immediate family or household requires care or support because of a personal illness or injury of the member or an unexpected emergency affecting the member.

Definition of Immediate family members or household members

Immediate family is:

spouse, de facto partner, child, parent, grandparent, grandchild, sibling, or a child, parent, grandparent, grandchild or sibling of the employee’s spouse or de facto partner.

A household member is any person who lives with the employee.

A business should include the notice requirements in a leave policy. For example, when a medical certificate is required and how the employee should advise the employer of when they need to take personal/carer’s leave.
